Terms of Service
These terms govern the use of the Orkelis platform and its applications.
1. Purpose
These Terms of Service (ToS) define the terms and conditions for using the Orkelis platform, accessible via the orkelis.com website and native iOS, Android, macOS, and Windows applications.
2. Acceptance of Terms
Using the Orkelis platform implies full and complete acceptance of these Terms. The user acknowledges having read these terms and agrees to comply with them.
3. Service Description
Orkelis is an intelligent team scheduling platform that generates optimized schedules, manages swap and leave requests, and ensures compliance with labor law and collective agreements.
4. Registration and User Account
Access to the service requires creating an account. The user agrees to provide accurate information and maintain the confidentiality of their login credentials. Any use of the account is deemed to be made by the account holder.
5. User Obligations
The user agrees to use the platform in accordance with its intended purpose, not to attempt to circumvent security measures, not to use the service for unlawful purposes, and to respect Orkelis intellectual property rights.
6. Service Availability
Orkelis strives to ensure service availability 24/7. Maintenance interruptions are possible and will be notified in advance where possible. Enterprise plan customers benefit from a guaranteed 99.9% SLA.
7. Intellectual Property
The Orkelis platform, its source code, algorithms (including the Athena engine), interface, and documentation are the exclusive property of Orkelis SAS. The user is granted a non-exclusive, non-transferable right of use for the duration of their subscription.
8. User Data and Content
The user retains ownership of their data. Orkelis claims no ownership rights over data entered by users. Upon termination, the user may export all their data in a standard format.
9. Pricing and Payment
Applicable prices are those displayed on the Pricing page at the time of subscription. Billing is monthly or annual based on the user's choice. In case of non-payment, access to the service may be suspended after a reminder.
10. Termination
The user may cancel their subscription at any time from their account settings. Cancellation takes effect at the end of the current period. No pro-rata refunds are issued except as provided by law.
11. Limitation of Liability
Orkelis shall not be liable for indirect damages resulting from the use or inability to use the service. Generated schedules are optimization suggestions; final validation remains the manager's responsibility.
12. Applicable Law and Jurisdiction
These Terms are governed by French law. Any dispute shall be submitted to the competent courts of Paris, unless otherwise provided by law.
